Under CPR Part 35, an expert witness’s overriding duty is to the court, not to the party who instructed them. The expert must provide an objective, independent opinion and must not act as an advocate for either side. Professor Hindocha is fully trained in these obligations and ensures every report reflects his genuine clinical opinion — regardless of which party has instructed him. This independence is what gives his evidence real weight in proceedings.

Yes. Written clarificatory questions from either party following delivery of the report are addressed at no additional charge, provided they fall within the scope of the original instruction. Where a supplementary report is required — for example, to address new medical evidence or respond to a joint statement — we will confirm whether any additional fee applies before proceeding.

Yes. Harley Street Legal accepts instructions from solicitors acting for claimants and defendants alike, as well as joint instructions. We do not take sides. Professor Hindocha forms his opinion on the clinical evidence in front of him — and that opinion does not change depending on who is asking the question.

Not always. Cases focused on breach of duty, causation, or standard of care can often be fully addressed by desktop review alone. Where the case turns on the current extent of scarring or functional limitation, an in-person examination at our Harley Street consulting rooms will usually be necessary. We will advise on the right approach at the point of instruction.
