Common Questions About RTA Expert Instructions
What records should I send with my letter of instruction?
Send all GP and hospital records relevant to the injury, A&E records, operative notes if surgery has taken place, physiotherapy records, any existing medical reports, and a full set of wound or scar photographs if available. Incomplete records will delay the report — if further records are anticipated, let us know and we can advise whether to wait or proceed on the material available.
How soon after the accident can an examination take place?
For scarring and soft tissue injuries, we recommend a minimum of six months post-accident where possible, allowing initial wound healing to stabilise. However, where liability is in dispute or court deadlines require it, earlier examination can be arranged with a supplementary report at a later stage when the injury has matured.
Can Professor Hindocha act as both treating surgeon and expert witness?
No. Where Professor Hindocha has treated the claimant, he is unable to act as independent expert witness in the same matter, as this would create a conflict of interest incompatible with CPR Part 35 obligations. In these circumstances, we can suggest appropriately qualified independent colleagues.
What is the difference between a desktop review and a full examination report?
A desktop review (also called a paper review) involves assessment of medical records and photographs only, without a clinical examination. It is suitable for straightforward cases or where the claimant is unable to attend. A full examination report involves clinical assessment at our consulting rooms and is appropriate for complex cases, significant scarring, or where quantum is disputed.
How are expert fees structured for RTA claims?
Fees are based on the complexity of the case and the time required for examination, record review, and report preparation. A fee estimate is provided before instruction is accepted. Reports are invoiced on completion. Fees for attendance at JSM, mediation, or court are quoted separately. We accept instruction from claimant and defendant solicitors, and also accept SJE appointments with agreed fees split between the parties.
